Terms and conditions

1. SCOPE OF SERVICES

Ponto Marine Services S.A. offers industrial and naval maintenance services, scaffolding installation and rental, thermal insulation, high-pressure water cleaning, industrial painting, and sandblasting, as specified in the quotes, work orders, or contracts previously approved by the client.

 

2. ACCEPTANCE OF TERMS

The contracting of any service implies the client's full and unreserved acceptance of these Terms and Conditions.

3. QUOTES AND PRICES

 

Quoted prices are subject to change without prior notice until the order is confirmed in writing. All quotes are valid for 15 calendar days, unless otherwise indicated.

 

4. PAYMENT TERMS

Payment must be made according to the terms agreed in the quote or contract. Ponto Marine Services S.A. reserves the right to suspend services if payments are outstanding. Late payments incur a 3% monthly surcharge.​

5. DELIVERY OR EXECUTION TIMES

Delivery or execution times are estimated and may vary due to external factors, force majeure, weather conditions, or restricted access to the site. The Client will be notified of any delays as far in advance as possible.

 

6. SITE ACCESS AND WORKING CONDITIONS

The Client must ensure safe access to the work site and provide adequate conditions for the performance of the services. Any delays caused by conditions beyond Ponto Marine's control will be the Client's responsibility.

 

7. WARRANTY

Services and products are guaranteed against manufacturing or workmanship defects for a period of 90 days, unless a different period is specified in the quote. The warranty does not cover damage caused by misuse, adverse environmental conditions, improper handling, or third-party intervention.

8. LIMITATION OF LIABILITY

Ponto Marine Services S.A. shall not be liable for indirect losses, lost profits, collateral damages, or operational interruptions arising from the use of its products or services. Total liability, in any case, shall not exceed the amount paid by the client for the specific service.

 

9. INTELLECTUAL PROPERTY

All technical documents, reports, images, data sheets, proposals, and other materials delivered to the client are the intellectual property of Ponto Marine Services S.A. and may not be reproduced, distributed, or used without written authorization.

 

10. CANCELLATIONS AND CHANGES

Any cancellation or modification of services must be notified in writing at least 72 hours in advance. Ponto Marine reserves the right to apply cancellation fees if costs have already been incurred or the service has begun.

11. FORCE MAJEURE

Ponto Marine Services S.A. shall not be liable for breaches arising from events beyond its control, including, but not limited to, natural disasters, labor disputes, pandemics, social unrest, or government actions.

 

12. APPLICABLE LAW AND JURISDICTION

These Terms and Conditions shall be governed by the laws of the Republic of Panama. Any dispute shall be resolved before the competent courts of Panama City.
